CCC Consumer Protection Notice No. 4 of 2022

The COMESA Competition Commission (the “Commission”) hereby notifies the general public that Ferrero International has recalled certain batches of its Kinder Chocolate Products across different countries.


Ferrero International, the manufacturer of Kinder range of chocolate products has recalled a number of its products from several countries in Europe, USA and Asia due to salmonella contamination. According to Ferrero International, all items being recalled were manufactured in the same facility in the Belgian town of Arlon and were sent for sale to several countries.


Salmonella bacteria can cause diarrhea, stomach cramps, nausea, vomiting and fever, and the symptoms could be more severe in young children and those with weakened immune systems.


The specific batches of the Kinder chocolate that have been recalled from different countries are as follows:

The Commission has also established that some Kinder chocolate products are imported and marketed in the Common Market for Eastern and Southern Africa (“the Common Market”).  In consideration of the risk, some of the COMESA Member States such as Kenya, Egypt and Sudan have launched a probe into Kinder products in their respective markets.


The Commission is conducting further investigation to ascertain the extent of the supply of the recalled products into the Common Market with a view of asking the manufacturers to:  (i) recall the affected products from the Common Market; (ii) issue a notice to the public indicating its distributors and related dealers in the Common Market to enable consumers identify where to return products; (iii) inform the public of any undertaking to replace the products or refund the price of the products; and (iv) desist from exporting the same products to the Common Market until such a time when the defect is corrected and the general public is informed accordingly.


In view of the foregoing and pursuant to Article 30(1)(b) of the COMESA Competition Regulations (“the Regulations”), the Commission would like to inform the general public to exercise caution and avoid the purchase or consumption of the above recalled products, and return them to the point of purchase for a full refund. Consumers who may have consumed the affected products and provide evidence that as a result of this consumption, they have suffered injury, have a right to compensation in accordance with Article 36 of the Regulations.


The Commission further wishes to request any person who purchased and/ or consumed the product and is unable to secure a refund or compensation, or who establishes that the recalled product is being sold in the Common Market to report the matter to the Commission on +265 (0) 1 772466 or contact the undersigned on mdisasa@comesa.int; or Mr. Steven Kamukama, Manager Consumer Welfare and Advocacy Division on skamukama@comesa.int.


Affected persons may also contact their national consumer institutions or any other body with the mandate on consumer protection in their countries.
